1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Probaly ("Company," "we," "our," or "us") governing your access to and use of the Probaly mobile application and website at probaly.net (collectively, the "Service").
By downloading, installing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must not access or use the Service.
2. Eligibility
To use Probaly, you must:
- Be at least 17 years of age
- Have the legal capacity to enter into a binding contract in your jurisdiction
- Not be prohibited from receiving services under applicable laws
- Provide accurate and truthful information when creating an account
By using the Service, you represent and warrant that you meet all eligibility requirements. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian.
3. Your Account
Account Creation
You must create an account to access most features of Probaly. You agree to provide accurate, current, and complete information during registration and to keep this information up to date.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:
- Use a strong, unique password
- Not share your account with any third party
- Notify us immediately at support@probaly.app if you suspect unauthorized access
We are not liable for any loss or damage arising from unauthorized use of your account.
One Account Per Person
Each person may maintain only one account. Creating multiple accounts to circumvent restrictions, abuse free trials, or manipulate the affiliate program is prohibited.
4. The Service
Probaly provides AI-generated sports predictions, match analysis, and probability insights. The Service includes:
- One free daily sports prediction tip
- Premium predictions across multiple sports for subscribers
- Historical prediction tracking
- Live match updates and analysis
- An affiliate referral program
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will endeavor to provide reasonable advance notice of significant changes.
5. Auto-Renewable Subscriptions & Payments
Probaly Premium — Subscription Plans
Probaly offers the following auto-renewable subscription plans under the product name "Probaly Premium":
- Monthly Plan: $49.99 per month
- Annual Plan: $149.00 per year ($12.42/month)
Premium subscribers receive unlimited access to all AI-powered sports predictions across all supported sports, live match updates, advanced filters, full prediction history, and analytics.
Billing & Auto-Renewal
Payment will be charged to your Apple ID account (iOS) or Google Play account (Android) at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
Managing & Cancelling Subscriptions
You can manage and cancel your subscriptions at any time by going to your account settings on the App Store (iOS) or Google Play Store (Android). Cancellation takes effect at the end of the current billing period — you retain access to premium features until then.
Refunds
Refunds are governed by Apple App Store and Google Play Store refund policies. We do not issue refunds directly.
Free Trial
If a free trial is offered, any unused portion of the free trial period will be forfeited when the user purchases a subscription.
Restore Purchases
If you reinstall the app or switch devices, you can restore your subscription by tapping "Restore Purchase" in the app's subscription screen.
Price Changes
We may change subscription prices at any time. Price changes will not affect your current billing cycle and will apply to the next renewal. We will notify you of price changes in advance.
6. Affiliate Program
Probaly offers an affiliate program that allows users to earn commissions by referring new subscribers. By participating in the affiliate program, you additionally agree to the following:
- Commission: Affiliates earn 40% of the net subscription revenue generated by their referred users.
- Clearance period: Commissions clear after 14 business days to account for refunds and chargebacks.
- Minimum payout: The minimum payout threshold is $10.00 USD.
- Payout method: Payouts are made via Stripe Connect. You must connect a valid bank account to receive payments.
- Approval: All payout requests are subject to manual review and approval by Probaly.
- Prohibited promotion: You may not promote Probaly using spam, misleading claims, paid search ads bidding on our brand terms, or any deceptive methods.
- Termination: We reserve the right to terminate affiliate accounts and withhold unpaid commissions if we detect fraud, abuse, or violation of these terms.
7. Predictions Disclaimer
- Sports outcomes are inherently uncertain. No prediction service — AI or otherwise — can guarantee results.
- Past prediction accuracy does not guarantee future performance.
- Probaly does not facilitate, encourage, or endorse sports betting or gambling of any kind.
- You are solely responsible for any decisions you make based on content from the Service.
- If you choose to engage in sports betting, you do so at your own risk and must comply with the laws and regulations of your jurisdiction.

8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable laws
- Reverse engineer, decompile, or attempt to extract the source code of the app
- Scrape, crawl, or use automated means to access or collect data from the Service
- Reproduce, distribute, or resell our predictions or content without written permission
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Use the Service to transmit spam, malware, or harmful content
- Impersonate any person or entity or misrepresent your affiliation
- Circumvent, disable, or interfere with security features of the Service
- Create fake accounts or manipulate the affiliate program
Violation of these prohibitions may result in immediate account termination and, where applicable, legal action.
9. Intellectual Property
All content on the Service, including but not limited to text, graphics, logos, AI-generated predictions, software, and the underlying algorithms, is the exclusive property of Probaly or its licensors and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include the right to resell, modify, or create derivative works from any content.
Your feedback, suggestions, or ideas submitted to us become our property and may be used without compensation or attribution to you.
10. Disclaimers & Limitation of Liability
Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free from viruses. We do not warrant the accuracy, completeness, or usefulness of any predictions or content.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROBALY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
Indemnification
You agree to indemnify, defend, and hold harmless Probaly and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Termination
We may suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for any reason, including if we reasonably believe you have violated these Terms.
You may terminate your account at any time by contacting us at support@probaly.app. Account termination does not entitle you to a refund of any prepaid subscription fees.
Upon termination, all licenses granted to you will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service will be resolved through good-faith negotiation first. If unresolved, disputes will be submitted to binding arbitration rather than resolved in court, except where prohibited by law.
Nothing in these Terms shall affect any mandatory rights you have under the consumer protection laws of your country of residence.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by:
- Posting the updated Terms on this page with a new effective date
- Sending a notification through the app or via email
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.
